NOTICE OF SUSPENSION Case No. 94-106-GA; 94-119-FA D. Richard Miller, P-33456, Oak Park, Michigan, by Attorney Discipline Board Tri-County Hearing Panel #76.

1) Suspension for 90 days; 2) Effective July 9, 1999.1. Respondent was retained to represent the defendant husband in a divorce matter. The hearing panel found, by a preponderance of the evidence, that respondent failed to file an answer or otherwise plead in a timely manner on his client's behalf. The default entered against respondent's client was subsequently set aside. The panel further found that the respondent failed to adequately communicate with his client in that matter. The panel also found that respondent improperly charged his client for time spent after the entry of the divorce judgment without providing a description or explanation for those additional charges.

Respondent's conduct was found to be in violation of MCR 9.104(1)-(4) and Michigan Rules of Professional Conduct 1.1(c); 1.3; 1.4; 3.2; and 8.4(a) and (c).

The panel ordered the suspension of respondent's license to practice law in Michigan for a period of 90 days. Costs were assessed in the amount of $2,293.75.

1. 1. Respondent's license was revoked effective February 24, 1994. See Grievance Administrator v Miller, ADB No. 123-89, et al. Respondent has not petitioned for reinstatement and that disqualification from the practice of law remains in effect.
