NOTICE OF REPRIMAND Case No. 95-200-GA William R. McFadden, P-17393, Royal Oak, Michigan, by the Attorney Discipline Board affirming Tri-County Hearing Panel #85's Order of Reprimand.

1) Reprimand; 2) Effective April 21, 1999. The panel found, by a preponderance of the evidence, that respondent represented both the seller and the buyer in a real estate transaction without obtaining each client's informed consent, and engaged in an improper business transaction with those clients. Respondent's conduct was found to be in violation of MCR 9.104(1)-(4) and Michigan Rules of Professional Conduct 1.2(a); 1.4(a) and (b); 1.7(a) and (c); 1.8(a)(1)-(3); and 8.4(a)-(c). On March 28, 1997, the panel entered an Order of Reprimand.

Respondent filed a petition for review. On August 14, 1997, the Board entered an Order Affirming Hearing Panel Order of Reprimand. Respondent filed two motions for reconsideration, which were denied by the Board in orders entered March 16, 1998 and April 17, 1998, respectively.

Respondent filed an application for leave to appeal, which was denied by the Michigan Supreme Court in an order entered December 30, 1998. Respondent filed a motion for reconsideration, which was denied by the Court in an order entered March 30, 1999.

Costs were assessed in the amount of $4851.29.
