NOTICE OF SUSPENSION (By Consent)
Case No. 98-193-GA Raymond F. Curtin, P-30779, Burton, Michigan, by Attorney Discipline Board Genesee County Hearing Panel #1.
1) Suspension - 270 Days; 2) Effective April 20, 1999. Respondent was retained to represent the complainants in a land contract foreclosure action. He was entrusted with $1,501.30 paid by the land contract vendee to the complainants, and deposited the funds into a bank account. Approximately two and one-half years later, the bank account at issue fell to a balance of less than $1,501.30, with an actual balance of $389.62. The account remained at a balance of less than $1,501.30 for approximately two weeks. Less than a month later, the account again fell to a balance of less than $1,501.30, with an actual balance of $937.80. Respondent pled no contest to allegations that he misappropriated all or part of the $1,501.30; and made a statement in his answer to the Request for Investigation which was false and was known by him to have been false at the time it was made, in violation of MCR 9.104(1), (2) and (4) and MRPC 8.4(a) and (c).
The parties stipulated that respondent be suspended from the practice of law in Michigan for a period of 270 days. Costs were assessed in the amount of $275.78.
