NOTICE OF SUSPENSION (Pending Appeal)
Case No. 96-269-GA Robert H. Golden, P-14108, Lathrup Village, Michigan, by the Attorney Discipline Board reducing Tri-County Hearing Panel #80's Order of Suspension for 180 days.
1) Suspension - 60 Days; 2) Effective June 5, 1999. The panel found that, during a deposition, respondent assaulted his opposing counsel in an attempt to recover papers produced by the deponent so as to prevent them from being marked as an exhibit. The panel concluded that respondent's conduct violated MCR 9.104(1)-(4); and Michigan Rules of Professional Conduct 6.5(a) and 8.4(a) and (c), and ordered that respondent be suspended from the practice of law in Michigan for a period of 180 days.
Respondent filed a petition for review and motion for stay of discipline. The motion for stay was granted by the Attorney Discipline Board. In an order and opinion issued May 14, 1999, the Board affirmed the panel's findings and reduced discipline to a 60-day suspension.
The Grievance Administrator filed an application for leave to appeal. Respondent filed neither an application for leave to appeal nor a motion for further stay of discipline, and the suspension is deemed to be effective June 5, 1999.
Costs were assessed in the amount of $1,075.90.
