Case No. 98-090-GA Judith Topham New, P-43496, Ann Arbor, Michigan, by Attorney Discipline Board Washtenaw County Hearing Panel #3.
1) Suspension - 30 Days; 2) Effective April 7, 1999; 3) Automatic Reinstatement; 4) Effective May 24, 1999. Respondent was appointed through the Michigan Appellate Assigned Counsel System (MAACS), to represent the complainant in his appeal of his conviction of Probation Violation, Jail Escape and Habitual Offender Third, for which he was incorrectly sentenced. The panel found that respondent neglected the matter, in violation of MCR 9.104(1)-(4); and Michigan Rules of Professional Conduct 1.1(c); 1.2(a); 1.3; 1.4(a); 3.2; and 8.4(a) and (c).
The parties stipulated that respondent be suspended from the practice of law in Michigan for a period of 30 days commencing April 7, 1999. In accordance with MCR 9.123(A), the suspension was terminated with the respondent's filing of an affidavit of compliance with the clerk of the Michigan Supreme Court on May 24, 1999.
Costs were assessed in the amount of $701.39.
