1. Revocation 2. Effective April 15, 1999 1 Based on respondent=s default, plea of no contest, and convictions, the panel found that respondent misappropriated funds, failed to account for funds, and failed to communicate with his clients in five matters; lied in his answers to four requests for investigation; failed to cooperate in the investigation of two requests for investigation; failed to answer one request for investigation; and made a false statement to a client and to the police. Additionally, respondent was convicted of three counts of Possession of a Controlled Substance Under 25 Grams, in violation of MCL 333.74032; one count of Resisting Arrest, in violation of MCR 750.479; and four counts of Credit Card Fraud, in violation of MCL 750.157.
Respondent=s conduct was in violation of MCR 9.103(C); MCR 9.104(1)-(7)*; MCR 9.113(A) and (B)(2); and Michigan Rules of Professional Conduct 1.1(c); 1.2(a); 1.3; 1.4; 1.15(a)-(c); 1.16(d); 8.1(a) and (b); and 8.4(a)-(c).
The hearing panel ordered that respondent=s license to practice law in Michigan be revoked, effective April 15, 1999, the date of his felony convictions. Additionally, respondent was ordered to pay restitution in the aggregate amount of $20,387.53.
The parties filed timely petitions for review and the Board dismissed respondent=s petition for review on February 18, 2003 and scheduled a hearing on petitioner=s cross-petition for review. Respondent filed a motion for reconsideration and a motion that all matters be held in abeyance, pursuant to MCR 9.121(5). In February 2004, the Board dismissed the respondent=s petition for review and petitioner=s cross-petition for review. Total costs were assessed in the amount of $980.09.
