NOTICE OF SUSPENSION Case No. 97-057-GA Mark S. Hamilton, P-31019, Ypsilanti, Michigan, by the Attorney Discipline Board affirming Tri-County Hearing Panel #16's Order of Suspension.
1) Suspension - 90 Days; 2) Effective May 20, 1999. Tri-County Hearing Panel #16 found that respondent failed to cooperate during the course of two separate disciplinary investigations, and ordered that he be suspended from the practice of law in Michigan for 90 days, noting his lack of respect for the discipline procedure.
The respondent and the Grievance Administrator each filed a petition for review. In an order and opinion issued June 12, 1998, the Attorney Discipline Board reversed the panel's dismissal of Count Three of the Formal Complaint, which alleged that respondent charged one complainant a clearly excessive fee and charged interest on the unpaid balance without prior consent, and otherwise affirmed the panel's findings and conclusions.
Respondent's conduct was found to be in violation of MCR 9.103(C); MCR 9.104(1)-(4); and Michigan Rules of Professional Conduct 1.5(a); 8.1(b); and 8.4(a) and (c). Costs were assessed in the total amount of $1,215.98.
Respondent filed an application for leave to appeal, which was denied by the Michigan Supreme Court in an order entered April 28, 1999.
