NOTICE OF REVOCATION Case Nos. 98-221-GA; 98-232-FA Arthur Allan Smith, P-20621, Dearborn and Inkster, Michigan, by Attorney Discipline Board Tri-County Hearing Panel #2.
1) Revocation; 2) Effective January 19, 1999. Respondent's license to practice law in Michigan was revoked effective February 3, 1993. He has not been reinstated to the practice of law to date. The panel found, by default, that respondent violated the Order of Revocation, as follows: During the period of revocation, he filed a Response to Complaint on behalf of a nurse in a professional licensing matter; appeared on behalf of the nurse at a hearing conducted by the Bureau of Occupational and Professional Regulation; gave to the Administrative Law Judge a business card which indicated his employment at Smith and Smith, P.C., Attorneys and Counselors at Law, and further represented that he was the nurse's "attorney;" failed to inform the tribunal of the revocation of his license to practice law in Michigan; and failed to timely answer the Formal Complaints. Respondent also failed to appear at the disciplinary hearing.
The panel concluded that respondent's conduct violated MCR 9.104(1)-(4), (7) and (9); MCR 9.119(D) and (E); MCL 600.916; MSA 27A.916; and Michigan Rules of Professional Conduct 3.4(c); 5.5(a); 8.1(b); and 8.4(a)-(c).
The panel ordered that respondent's license to practice law in Michigan be revoked for the second time effective January 19, 1999, the date of the disciplinary hearing. Costs were assessed in the amount of $166.29.
