NOTICE OF SUSPENSION WITH CONDITIONS and NOTICE OF AUTOMATIC REINSTATEMENT

Respondent was convicted in the 7 th Judicial Circuit Court, by a jury verdict, of failure to stop after an accident resulting in serious aggravated personal injury or death, a felony, in violation of MCL 257.617. In accordance with MCR 9.120(B)(1), respondent was automatically suspended from the practice of law in Michigan effective January 21, 1999. See Notice of Automatic Interim Suspension dated April 12, 1999.

The Grievance Administrator filed a certified copy of the Judgment of Conviction on April 1, 1999. The matter was assigned to a hearing panel and respondent was ordered to show cause why a final order of discipline should not be entered. On July 19, 1999, the hearing panel ordered the suspension of respondent=s license to practice law for a period of 179 days commencing January 21, 1999. The panel further ordered that respondent should be placed on probation for a period to coincide with the probation imposed by the Genesee County Circuit Court. During that probation period, respondent shall participate in the State Bar of Michigan Lawyers and Judges Assistance Monitoring Program. Costs were assessed in the amount of $746.91.

In accordance with MCR 9.123(A), respondent=s suspension was terminated with his filing of an affidavit of compliance with the clerk of the Michigan Supreme Court of August 12, 1999.
