NOTICE OF SUSPENSION WITH CONDITIONS Case Nos. 98-182-GA; 98-207-FA Bradley S. Montgomery, P-47215, Saginaw, Michigan, by Attorney Discipline Board Saginaw County Hearing Panel #1.

1) Suspension - 180 Days; 2) Effective January 20, 1999. The complainant was sentenced to serve six months in jail and placed on five years probation following his plea based conviction of misdemeanor stalking. Respondent was later appointed to represent the complainant on appeal. The panel found, by default, that respondent neglected and abandoned the matter; made a representation in his answer to the Request for Investigation which was false and was known by him to have been false at the time it was made; and failed to timely answer the Formal Complaints.

The panel concluded that respondent's conduct violated MCR 9.103(C); MCR 9.104(1)-(4), (6) and (7); MCR 9.113(A); and Michigan Rules of Professional Conduct 1.1(a)-(c); 1.2(a); 1.3; 1.4(a) and (b); 1.16(d); 3.2; 8.1(a) and (b); and 8.4(a)-(c).

The panel ordered that respondent be suspended from the practice of law in Michigan for 180 days, and take continuing legal education in law office management and/or basic practice. Costs were assessed in the amount of $406.59.
