NOTICE PROBATION AND RESTITUTION (By Consent)
Case No. 98-124-GA Neal Bush, P-11471, Detroit, Michigan, by Attorney Discipline Board Tri-County Hearing Panel #20.
1) Probation - Two (2) Years; 2) Effective September 18, 1998. Respondent was paid $3,000 to represent the complainant concerning post-conviction relief and parole matters. Respondent pled no contest to allegations that he neglected the matter; failed to refund $2,000 of the fee or to release the client file upon request; and failed to cooperate in the AGC's investigation.
Based on respondent's plea of no contest, the panel found that his conduct violated MCR 9.103(C); MCR 9.104(1)-(4); and Michigan Rules of Professional Conduct 1.1(a)-(c); 1.2(a); 1.3; 1.4(a) and (b); 1.5(a); 1.16(d) 8.1(b); and 8.4(a) and (c).
The parties stipulated that respondent be placed on probation for a term of two years; make restitution to the complainant in this matter in the sum of $2,000 and return his file; and make restitution to the complainant in an unrelated investigative file in the sum of $1,500 and return his client file.
Costs were assessed in the amount of $164.60.
