1) Suspension - 30 Days; 2) Effective October 28, 1998. Respondent was retained to represent the complainant in two separate criminal matters, one in 36th District Court and one in Recorder's Court. Respondent requested and received a fee of $7,000 for both matters. The panel found that respondent failed to refund the unearned portion of fee to the complainant until the date of the final disciplinary hearing.
The panel concluded that respondent's conduct violated MCR 9.104(1)-(4); and Michigan Rules of Professional Conduct 1.5(a); 1.15(b); 1.16(d); and 8.4(a) and (c).
The panel ordered that respondent be suspended from the practice of law in Michigan for 30 days. Costs were assessed in the amount of $527.68.
