1) Revocation; 2) Effective June 19, 1998.1. Respondent was retained to represent the first complainants in a bankruptcy matter. The panel found, by default, that respondent failed to surrender, upon demand, the file and documents to which the complainants were entitled.
Respondent was retained to represent the second complainant in a bankruptcy matter. The panel found that respondent neglected and abandoned the matter; failed to refund $585 in unearned fees.
Respondent was retained by the third complainant to file a petition for bankruptcy. The panel found that respondent neglected and abandoned the matter; failed to refund $775 in unearned fees.
Respondent failed to answer all three Requests for Investigation and both Formal Complaints, and failed to appear at the disciplinary hearing.
Respondent's conduct was found to be in violation of MCR 9.103(C); MCR 9.104(1)-(4) and (7); MCR 9.113(A) and (B)(2); and Michigan Rules of Professional Conduct 1.1(c); 1.2(a); 1.3; 1.4(a) and (b); 1.5; 1.15(b); 1.16(d); 3.2; 8.1(b); and 8.4(a) and (c).
The panel ordered that respondent's license to practice law in Michigan be revoked for the second time,2. and make restitution to the complainants in the total amount of $1,860. Costs were assessed in the amount of $324.55. 1. Respondent has been continuously suspended from the practice of law in Michigan since January 28, 1997.
2. Respondent's license to practice law was also revoked in Case Nos. 97-106-GA; 97-133-FA, effective July 31, 1997.
