NOTICE OF SUSPENSION WITH CONDITIONS AND RESTITUTION Case No. 98-48-GA David M. Dean, P-30903, Port Huron, Michigan, by Attorney Discipline Board St. Clair County Hearing Panel.

1) Suspension - 180 Days; 2) Effective August 19, 1998. In April 1997, respondent was retained to represent the complainant in a real estate matter. Respondent was suspended from the practice of law for 30 days commencing July 18, 1997, and until he complied with the requirements of MCR 9.123(A).1.

Respondent admitted that he failed to notify the complainant that he was suspended from the practice of law and filed an Affidavit of Compliance which falsely indicated that he was in compliance with the Order of Suspension by notifying his clients of his inability to practice law.

Respondent's conduct was found to be in violation of MCR 9.104(1)-(4) and (9); MCR 9.119(A); and Michigan Rules of Professional Conduct 8.4(a)-(c).

The panel ordered that respondent be suspended from the practice of law for 180 days commencing August 19, 1998, to run consecutive to the 180-day suspension currently in effect in Case Nos. 96-157-GA et al, subject to the same conditions contained in the Orders of Suspension With Conditions entered in Case No. 97-61-GA and Case Nos. 96-157-GA; 96-173-FA. The panel further ordered respondent to make restitution to the complainant in the amount of $300.00. Costs were assessed in the amount of $265.08. 1. 1. Respondent has not complied with MCR 9.123(A) to date, and remains suspended from the practice of law. Respondent was also suspended from the practice of law in Michigan for 180 days effective February 20, 1998.
