NOTICE OF SUSPENSION AND RESTITUTION Case Nos. 98-32-GA; 98-60-FA Harry R. Boffman, III, P-55052, Southfield, Michigan, by Attorney Discipline Board Tri-County Hearing Panel #73.

1) Suspension - Thirty (30) Days; 2) Effective June 12, 1998. Respondent pled no contest to allegations that he failed to answer the Request for Investigation and the Formal Complaints, in violation of MCR 9.103(C); MCR 9.104(1)-(4) and (7); MCR 9.113(A) and (B)(2); and Michigan Rules of Professional Conduct 8.1(b) and 8.4(a) and (c).

Although the conduct which is the subject of the Request for Investigation was not charged in the Formal Complaint, as the conduct occurred prior to respondent's admission to the bar, the complainant testified in aggravation. The complainant, a representative of the BAR/BRI Bar Review Course, testified that respondent paid for his Bar Review Course with two checks which were dishonored for non-sufficient funds, and failed to make good on the checks despite repeated letters and telephone calls from BAR/BRI requesting payment.

The panel ordered that respondent be suspended from the practice of law for a period of thirty days and make restitution to BAR/BRI in the amount of $975.00. Costs were assessed in the amount of $175.12.
