NOTICE OF REPRIMAND Case No. 95-210-GA Leonard B. Segel, P-32122, Southfield, Michigan, by the Attorney Discipline Board vacating Tri-County Hearing Panel #72's order imposing no discipline.

1) Reprimand; 2) Effective June 2, 1998. The Formal Complaint alleges that respondent improperly conducted himself at a deposition by using abusive language toward opposing counsel and by refusing to surrender documents presented to the deponent by opposing counsel. On February 21, 1996, the panel entered an Order of Dismissal.

The Grievance Administrator filed a petition for review. On August 7, 1996, the Attorney Discipline Board reversed the panel's Order of Dismissal, found that respondent had violated MRPC 8.4(c) and MCR 9.104(1), (2) and (4), and remanded the case to the panel for a hearing on discipline pursuant to MCR 9.115(J)(2).

On October 16, 1997, following the hearing on discipline, the panel entered an order imposing no discipline. The Grievance Administrator filed a second petition for review. On May 11, 1998, the Board entered an order and opinion vacating the no- discipline order and imposing a reprimand. A dissenting Board Member would impose a thirty-day suspension.

Costs were assessed in the total amount of $1,383.06.
