1) Suspension - Two (2) Years and Eleven (11) Months; 2) Effective July 24, 1998.1. From January 1992 through October 1995, respondent was appointed to seek post-conviction relief on behalf of numerous indigent criminal defendants as a result of his participation on the Michigan Assigned Appellate Counsel System roster. The panel found, by default, that respondent neglected twenty-seven (27) such matters; failed to answer three (3) Requests for Investigation; and failed to answer two (2) Formal Complaints. Respondent also failed to appear at the disciplinary hearing.
Respondent's conduct was found to be in violation of MCR 9.103(C); MCR 9.104(1)-(4) and (7); MCR 9.113(A) and (B)(2); and Michigan Rules of Professional Conduct 1.1(a) and (c); 1.2(a); 1.3; 1.4; 3.4(c); 8.1(b); and 8.4(a) and (c).
The panel ordered that respondent be suspended from the practice of law in Michigan for a period of two (2) years and eleven (11) months. Costs were assessed in the amount of $639.19. 1. Respondent has been continuously suspended from the practice of law in Michigan since January 21, 1997.
