NOTICE OF SUSPENSION (By Consent)

Case No. 93-117-GA James J. Rostash, P-19685, Monroe, Michigan, by Attorney Discipline Board Tri-County Hearing Panel #32.

1) Suspension - 90 Days; 2) Effective May 19, 1998. Respondent entered a plea of no contest to allegations that he agreed with another person or persons improperly to affect the judicial assignment of a criminal case in a manner contrary to MCR 8.111(B), by accepting an association as co-counsel so as to take advantage of the perpetual disqualification of a certain judge to have a case which was duly and properly assigned to that judge removed to the docket of another judge with a reputation of imposing more lenient sentences. The panel concluded that respondent's conduct violated MCR 9.104 (1)-(4) and Michigan Rules of Professional Conduct 8.4(a) and (c).

The parties stipulated that respondent be suspended from the practice of law in Michigan for 90 days retroactive to May 19, 1998, to run concurrent to the suspension imposed in Case No. 93- 116-GA. Costs were assessed in the amount of $412.90.
