NOTICE OF REPRIMAND (By Consent)
Case No. 97-282-GA John R. Beason, P-34095, Grand Rapids, Michigan, by Attorney Discipline Board Kent County Hearing Panel #5.
1) Reprimand; 2) Effective May 12, 1998. Respondent was retained to represent the husband in a divorce action. Respondent pled no contest to allegations that he used and divulged information which he knew or should reasonably have known to have been obtained from a device used to eavesdrop upon and record telephone conversations between his client's wife and others, without the knowledge and consent of either his client's wife or any other party to the telephone conversation.
Respondent's conduct was alleged to be in violation of MCL 750.539(E); 18 USC 2511 and 2515; MCR 9.104(1)-(5); and Michigan Rules of Professional Conduct 1.1(b); 1.2(c); 4.4; and 8.4(a)- (c).
The parties stipulated that respondent be reprimanded. Costs were assessed in the amount of $102.23.
