NOTICE OF REVOCATION AND RESTITUTION Case Nos. 97-303-GA; 98-4-FA Paul G. Viele, P-28119, Bay City and Vassar, Michigan, by Attorney Discipline Board Saginaw County Hearing Panel #1.
1) Revocation; 2) Effective April 7, 1998. Respondent was retained by the complainant to institute a lawsuit in regard to a property dispute. The panel found, by default, that respondent neglected the matter; made statements to the complainant which were false and were known by him to have been false at the time they were made; failed to refund the unearned $1,350 fee to the complainant; failed to answer the Request for Investigation; and failed to answer the Formal Complaints. Respondent also failed to appear at the disciplinary hearing.
Respondent's conduct was found to be in violation of MCR 9.103(C); MCR 9.104(1)-(4) and (7); MCR 9.113(A) and (B)(2); and Michigan Rules of Professional Conduct 1.1(c); 1.2(a); 1.3; 1.4; 1.15(b); 1.16(d); 3.2; 8.1(b); and 8.4(a)-(c).
The panel ordered that respondent's license to practice law in Michigan be revoked for the second time,1. and that he make restitution to the complainant in the amount of $2,000. Costs were assessed in the amount of $246.99. 1. Respondent has been continuously suspended from the practice of law in Michigan since January 28, 1997. His license was also revoked in a separate matter, effective December 23, 1997.
