NOTICE OF REPRIMAND Case Nos. 97-68-GA; 97-99-FA Gregory S. Thompson, P-39258, Southfield, Michigan, by the Attorney Discipline Board vacating Tri-County Hearing Panel #73's Order Regarding Discipline.

1) Reprimand; 2) Effective April 2, 1998. Respondent admitted that he failed to answer the Request for Investigation and the Formal Complaints, in violation of MCR 9.103(C); MCR 9.104(1)-(4) and (7); MCR 9.113(A) and (B)(2); and Michigan Rules of Professional Conduct 8.1(b) and 8.4(a) and (c). The panel found that the failures to answer constituted misconduct but concluded that public discipline was not warranted. On October 10, 1997, Tri-County Hearing Panel #73 entered its report and Order Regarding Discipline which admonished respondent for his failure to answer the Request for Investigation and the Formal Complaints.

The Grievance Administrator filed a petition for review. On March 11, 1998, the Attorney Discipline Board entered an opinion in which it held that the power to admonish an attorney rests solely with the Attorney Grievance Commission under the procedure outlined in MCR 9.106(6), and that the panel's decision to impose no discipline was inappropriate under the facts of this case. With that opinion, the Board entered an Order Vacating Hearing Panel Order Regarding Discipline and Imposing Reprimand. Costs were assessed in the total amount of $426.32.
