NOTICE OF REPRIMAND (By Consent)
Case No. 98-2-GA Ben M. Gonek, P-43716, Detroit, Michigan, by the Attorney Discipline Board affirming Tri-County Hearing Panel #11's Order of Reprimand (By Consent).
1) Reprimand; 2) Effective March 19, 1998. The complainant was convicted, in Recorder's Court for the City of Detroit, of Breaking and Entering With Intent to Commit Criminal Sexual Conduct and First Degree Criminal Sexual Conduct. Respondent was retained to represent the complainant on appeal of that conviction, and filed a Claim of Appeal with the Michigan Court of Appeals.
Respondent entered a plea of no contest to allegations that he failed to timely file a brief on the complainant's behalf, in violation of MCR 9.104(1)-(4); and Michigan Rules of Professional Conduct 1.1(c); 1.3; 3.2; and 8.4(a) and (c).
The parties stipulated that respondent be reprimanded. Costs were assessed in the amount of $73.95.
The complainant filed a petition for review. In an order issued July 13, 1998, the Attorney Discipline Board affirmed the panel's order.
