NOTICE OF REVOCATION AND RESTITUTION Case Nos. 97-215-GA; 97-237-FA Herbert H. Schebor, P-23988, Garden City, Michigan, by Attorney Discipline Board Tri-County Hearing Panel #23.

1) Revocation; 2) Effective March 3, 1998. The panel found, by default, that respondent continued to hold himself out as an attorney and to practice law after the effective date of prior orders of suspension and revocation;1. neglected a matter entrusted to him by a client and failed to refund the unearned $587.00 fee to that client; failed to answer three Requests for Investigation; and failed to answer the Formal Complaint. Respondent also failed to appear at the disciplinary hearing.

Respondent's conduct was found to be in violation of MCR 9.103(C); MCR 9.104(1)-(4) and (7); MCR 9.113(A) and (B)(2); MCR 9.119(A), (B) and (E); MCL 600.916; MSA 27A.916; and Michigan Rules of Professional Conduct 1.1(a)-(c); 1.3; 1.4; 1.15(b); 1.16(d); 3.2; 5.5(a); 8.1(b); and 8.4(a)-(c).

The panel ordered that respondent's license to practice law be revoked for the third time, and that he make restitution to the complainants in the total amount of $1,787.00. The panel further noted that:

This panel is of the view that the respondent will continue to practice law without a license despite any action that this panel, or any panel of the Attorney Discipline Board takes. Therefore, it recommends that other legal action be taken and that this case be recommended for action by other authorities.

Costs were assessed in the amount of $171.49. 1. Respondent has been continuously suspended from the practice of law since July 29, 1995. His license to practice law was also revoked in two prior matters, effective August 2, 1996 and November 15, 1997.
