1) Reprimand; 2) Effective March 14, 1998. The panel found, by stipulation, that respondent filed a civil action against the complainant based upon the complainant's filing of a Request for Investigation against him, in violation of MCR 9.104(1)-(4); MCR 9.125; and Michigan Rules of Professional Conduct 3.1 and 8.4(a) and (c).
The panel ordered that respondent be reprimanded and make restitution to the complainant in the amount of $370.52, which represents attorney fees incurred by the complainant to defend the civil action respondent filed against him plus mileage reimbursement to attend the disciplinary hearing. Costs were assessed in the amount of $280.59.
