NOTICE OF SUSPENSION WITH CONDITIONS Case Nos. 96-157-GA; 96-173-FA David M. Dean, P-30903, Port Huron, Michigan, by Attorney Discipline Board St. Clair County Hearing Panel.

1) Suspension - 180 Days; 2) Effective February 20, 1998. Respondent filed an appearance on behalf of the complainant in a bankruptcy action. The panel found that respondent neglected the matter as follows: He failed to file responses to claims for non-dischargeability of debt, causing defaults to be entered against the complainant; and failed to either withdraw or take the appropriate legal action necessary to protect the interest of the complainant. Respondent's conduct was found to be in violation of MCR 9.104(1)-(4); and Michigan Rules of Professional Conduct 1.1(c); 1.3; 1.4(a) and (b); 1.16(d); 3.2; and 8.4(a) and (c).

Following a separate hearing to determine the appropriate discipline, the panel ordered that respondent be suspended from the practice of law for 180 days, and comply with all of the conditions set forth in the Order of Suspension With Conditions entered in Case No. 97-61-GA.1. Costs were assessed in the amount of $1,527.53. 1. Suspension thirty (30) days with conditions, effective July 18, 1997. Respondent has not been reinstated from that suspension and it remains in effect to date.
