NOTICE OF REVOCATION Case Nos. 97-119-GA; 97-149-FA Paul G. Viele, P-28119, Bay City and Vassar, Michigan, by Attorney Discipline Board Genesee County Hearing Panel #5.

1) Revocation; 2) Effective December 23, 1997. Respondent was retained to represent a client in a divorce matter. The panel found, by default, that respondent neglected the matter by failing to file a divorce action on his client's behalf; made statements to his client which were false and were known by him to have been false at the time they were made; fabricated, or caused to be fabricated, an "Order Setting Trial Schedule" to lead his client to believe that her divorce had been filed and was scheduled for trial; and failed to answer the Formal Complaints. Respondent also failed to appear at the disciplinary hearing.

Respondent's conduct was found to be in violation of MCR 9.104(1)-(4) and (7); and Michigan Rules of Professional Conduct 1.1(a)-(c); 1.3; 1.4(a) and (b); 3.2; 8.1(b); and 8.4(a)-(c).

The panel ordered that respondent's license to practice law in Michigan be revoked effective December 23, 1997.1. Costs were assessed in the amount of $246.56. 1. Respondent has been continuously suspended from the practice of law in Michigan since January 28, 1997.
