NOTICE OF REVOCATION AND RESTITUTION Case Nos. 97-257-GA; 97-279-FA Barry W. Litvin, P-16736, Southfield, Michigan, by Attorney Discipline Board Tri-County Hearing Panel #79.

1) Revocation; 2) Effective January 31, 1998. Respondent was retained to represent the complainant in a landlord/tenant small claims matter filed against her in the 36th District Court. The panel found, by default, that respondent neglected the matter, resulting in the entry of a $1,385 default judgment against the complainant; failed to advise the complainant, the court or the opposing party of his disqualification from the practice of law;1. failed to answer the Request for Investigation; and failed to answer the Formal Complaints. Respondent also failed to appear at the disciplinary hearing.

Respondent's conduct was found to be in violation of MCR 9.103(C); MCR 9.104(1)-(4) and (7); MCR 9.113(A) and (B)(2); MCR 9.119(A) and (B); and Michigan Rules of Professional Conduct 1.1(c); 1.2(a); 1.3; 1.4(a); 3.2; 8.1(b); and 8.4(a) and (c).

The panel ordered that respondent's license to practice law be revoked for the third time, and that he make restitution to the complainant in the amount of $1,385. Costs were assessed in the amount of $145.73. 1. Respondent was suspended from the practice of law in Michigan for a period of eighteen months effective June 27, 1996, in Case Nos 96-73-GA; 96-90-FA. His license to practice law was also revoked twice before, effective November 28, 1996, in Case Nos. 96-198-GA; 96-216-FA; 96-232-GA, and effective September 12, 1997, in Case Nos. 97-144-GA; 97-162-FA.
