NOTICE OF SUSPENSION Case Nos. 99-147-AI; 99-150-JC Notice Issued: April 23, 2001 Michael J. Garzoni, P-34927, Macomb Twp., Michigan by Attorney Discipline Board Tri-County Hearing Panel #18.

1. Suspension - 54 Months; 2. Effective October 23, 1997. On October 23, 1997, respondent was convicted, by guilty plea, of two counts of interstate transportation of property taken by fraud in violation of 18 U.S.C. 2314 and 2 and one count of securities fraud in violation of 15 U.S.C. 78j(b) and 78ff, 17 C.F.R. 240.10b-5. (United States District Court for the Eastern District of Michigan Case Numbers 96-80764 and 96-80858.) In accordance with MCR 9.120(B)(1), respondent=s license to practice law in Michigan was automatically suspended on the date of that felony conviction.

On September 20, 1999, the Grievance Administrator filed a judgment of conviction pursuant to MCR 9.120(B)(3). In accordance with that rule, the Attorney Discipline Board ordered respondent to appear to show cause why a final order of discipline should not be entered. On December 18, 2000, the hearing panel issued an order suspending respondent's license for 54 months effective June 3, 1998. The respondent filed a motion for reconsideration to have the effective date of his suspension changed to October 23, 1997, the date of his conviction. On March 29, 2001, the hearing panel issued an order granting respondent's motion. Costs were assessed in the amount of $248.36.
