1) Reprimand; 2) Effective October 30, 1997. Respondent filed a personal injury action on behalf of a husband and wife in Macomb County Circuit Court. The wife's claim was for loss of consortium. While the personal injury action was pending, respondent filed a divorce action on behalf of the husband. The panel found that notwithstanding his representation of the wife in a personal injury action, he represented the husband in a divorce action, creating a conflict of interest.
Respondent's conduct was found to be in violation of MCR 9.104(1)-(4); and Michigan Rules of Professional Conduct 1.6; 1.7; and 8.4(a)-(c).
The panel ordered that respondent be reprimanded. Costs were assessed in the amount of $381.63.
