NOTICE OF SUSPENSION AND RESTITUTION (By Consent)

1) Suspension - Two (2) Years; 2) Effective July 29, 1997. Respondent entered a plea of no contest to the allegations of professional misconduct contained in Formal Complaint 96-205- GA, which include nineteen (19) counts of neglecting post- conviction criminal matters assigned to him by the Michigan Assigned Appellate Counsel System [MAACS]; one count of knowingly making a false statement to MAACS; one count of filing a frivolous trial court motion; and one count of charging and collecting a clearly excessive fee regarding the frivolous trial court motion.
Respondent's conduct was alleged to be in violation of MCR 9.104(1)-(4); and Michigan Rules of Professional Conduct 1.1(b) and (c); 1.2(a); 1.3; 1.4; 1.5(a); 1.16(a)(1) and (3); 3.1; 3.2; 3.3(a)(3); 4.1; and 8.4(a)-(c).
The parties stipulated that respondent be suspended from the practice of law in Michigan for two years effective July 29, 1997, and make restitution to eleven complainants in the total amount of $19,698.51. Costs were assessed in the amount of $603.89.
