NOTICE OF REPRIMAND WITH CONDITION Case Nos. 95-234-GA; 95-264-FA Mary L. Banks, P-44700, Detroit, Michigan, by Attorney Discipline Board Tri-County Hearing Panel #33.
1) Reprimand; 2) Effective July 19, 1997. On July 3, 1996, the panel entered its report and order of dismissal in this matter. The Grievance Administrator filed a petition for review. On review, the Attorney Discipline Board affirmed the panel's dismissal of Count One of Formal Complaint 95-234-GA. However, the Board reversed the panel's dismissal of Count Two of Formal Complaint 95-234-GA, which charges that respondent failed to answer a Request for Investigation, and of Formal Complaint 95-264-FA, which charges that respondent failed to timely answer Formal Complaint 95-234-GA. Respondent's conduct violated MCR 9.103(C); MCR 9.104(1)-(4) and (7); MCR 9.113(A) and (B)(2); and Michigan Rules of Professional Conduct 8.1(b) and 8.4 (a) and (c). The Board remanded the matter to the hearing panel for a hearing on discipline in accordance with MCR 9.115(J)(2).
Following a hearing pursuant to the Order of Remand, the panel entered a supplemental report and Order of Reprimand With Condition. The condition imposed directs respondent to complete a course in law office management within one year. Costs were assessed in the total amount of $1035.07.
