NOTICE OF SUSPENSION WITH CONDITIONS Case No. 97-61-GA David M. Dean, P-30903, Port Huron, Michigan, by Attorney Discipline Board Tri-County Hearing Panel #102.

1) Suspension - Thirty (30) Days; 2) Effective July 18, 1997. In May 1996, respondent employed a process server to serve a summons and complaint. Respondent prepared, executed and delivered a check in the amount of $25 payable to the process server. Respondent admitted that, at the time he prepared, executed and delivered the check, he knew or should have known that there were insufficient funds on deposit to honor the draft. The check was dishonored upon presentment, and was not made good for approximately one year. Respondent also admitted that he failed to answer the Request for Investigation. Respondent admitted that his conduct violated MCR 9.103(C); MCR 9.104(1)-(4) and (7); MCR 9.113(A) and (B)(2); and Michigan Rules of Professional Conduct 8.1(b) and 8.4(a) and (c).

The panel ordered that respondent be suspended from the practice of law for thirty days with conditions relevant to the established misconduct. Costs were assessed in the amount of $250.52.
