NOTICE OF REPRIMAND Case No. 94-185-GA Michael J. Riley, P-32233, Baldwin, Michigan, by the Attorney Discipline Board vacating Muskegon County Hearing Panel #2's Order of Dismissal.

1) Reprimand; 2) Effective June 12, 1997. On March 15, 1995, Muskegon County Hearing Panel #2 entered an order of dismissal. The Grievance Administrator filed a petition for review. On October 10, 1995, the Attorney Discipline Board entered an order of remand vacating the dismissal and remanding the matter to Muskegon County Hearing Panel #2 for a further hearing on the charges of misconduct. Respondent filed an application for leave to appeal, which was denied by the Michigan Supreme court in an order entered July 29, 1996.

On October 21, 1996, Muskegon County Hearing Panel #2 entered a second order of dismissal. The Grievance Administrator filed a second petition for review. On May 21, 1997, the Attorney Discipline Board entered an Order of Reprimand and Board Opinion. The Board majority found that the record established, prima facie, that respondent, a county prosecutor, made comments about a pending criminal case to the editor of a local newspaper before the jury had returned its verdict, in violation of Michigan Rule of Professional Conduct 3.6 [Trial Publicity].

Costs were assessed in the amount of $1,050.14.
