NOTICE OF SUSPENSION Case Nos. 97-59-GA; 97-90-FA Robert M. Gordon, P-46623, Ann Arbor, Michigan, by Attorney Discipline Board Washtenaw County Hearing Panel #1.

1) Suspension - Three (3) Years; 2) Effective July 17, 1997. Respondent was appointed as co-personal representative of his deceased grandmother's estate, and also acted as attorney with respect to the estate. The panel found, by default, that respondent neglected the estate; withdrew $81,587.67 in funds from the estate account to which he was not entitled and commingled and misappropriated those moniues; failed to make restitution when his conduct was discovered and did not do so under the Request for Investigation was filed against him; and failed to answer the Formal Complaints. Respondent also failed to appear at the disciplinary hearing.

Respondent's conduct was found to be in violation of MCR 9.104(1)-(4) and (7); and Michigan Rules of Professional Conduct 1.1(a)-(c); 1.3; 1.15(a)-(c); 3.2; 3.4(c); 8.1(b); and 8.4(a)- (c).

The panel ordered that respondent be suspended from the practice of law for three years. Costs were assessed in the amount of $389.73.
