NOTICE OF SUSPENSION WITH CONDITIONS Case Nos. 96-257-GA; 96-281-FA Richard D. Carr, P-39763, Munising, Michigan, by Attorney Discipline Board Upper Peninsula Hearing Panel #1.

1) Suspension - 180 Days; 2) Effective May 13, 1997. The panel found, by default, that respondent neglected two circuit court criminal matters, three district court criminal matters and two district court civil matters; failed to timely appear for a show cause hearing and appeared at that hearing while intoxicated; was convicted of misdemeanor Operating Under the Influence of Liquor; and failed to answer the Formal Complaints.

Respondent's conduct was found to be in violation of MCR 9.104(1)-(4) and (7); and Michigan Rules of Professional Conduct 1.1(c); 1.3; 1.4; 3.2; 3.4(c); 3.5(c); 8.1(b); and 8.4(a) and (c).

The panel ordered that respondent be suspended from the practice of law for 180 days with conditions relevant to the established misconduct. Costs were assessed in the amount of $449.17.

NOTE: Respondent was also suspended from the practice of law for failure to pay his annual dues to the State Bar of Michigan effective January 28, 1997.
