1) Revocation; 2) Effective April 3, 1997. Respondent was retained to represent five separate complainants in a variety of matters, including a real estate matter, a bankruptcy matter, a criminal matter, two divorce matters, and a civil dispute. The panel found, by default, that respondent neglected the matters; failed to refund unearned fees; failed to release a client's file upon request; misappropriated $800 in alimony payments received on behalf of a client; failed to answer five Requests for Investigation; and failed to answer the Formal Complaints. Respondent also failed to appear at the disciplinary hearing.
Respondent's conduct was found to be in violation of MCR 9.103(C); MCR 9.104(1)-(4) and (7); MCR 9.113(A) and (B)(2); and Michigan Rules of Professional Conduct 1.1(c); 1.3; 1.4; 1.5(a) and (b); 1.15; 1.16(d); 3.2; 8.1(b) and 8.4(a)-(c).
The panel ordered that respondent's license to practice law be revoked and that he make restitution to the complainants in the total amount of $3,560 plus interest. Costs were assessed in the amount of $399.35.
NOTE: Respondent has been continuously suspended from the practice of law in Michigan since June 21, 1996.
