NOTICE OF SUSPENSION Case No. 96-126-GA Hoyt P. Spicer, II, P-20835, Detroit, Michigan, by the Attorney Discipline Board affirming Tri-County Hearing Panel #9's Order of Suspension.

1) Suspension - 180 Days; 2) Effective March 6, 1997. Respondent admitted that he misrepresented on an "Applica- tion for Michigan Title" that he was acting as his deceased mother's personal agent, knowing that he had no authority to do so; signed his mother's name on an "Appointment of Agent" document, indicating that he was authorized to purchase and title a vehicle in his mother's name; filed the "Appointment of Agent" document with the Secretary of State knowing that the document was false; filed an Application for Commercial Vehicle Registration Plates with the Secretary of State, indicating that his mother owned the vehicle, and as a result, a registration plate was issued to his deceased mother which he affixed to the vehicle; signed his mother's name identifying her as the owner of the vehicle on the Commercial Vehicle Registration forms issued by the Secretary of State, and filed those forms with Secretary of State knowing that the forms were false. He further admitted that he used the vehicle in such a fashion that it was cited for 468 parking violations, resulting in more than $11,600 in fines and penalties; repeatedly used the vehicle in a manner contrary to the City of Detroit Parking Laws; and failed to timely pay the fines and penalties. Respondent's conduct was found to be in violation of MCR 9.104(1)-(4) and Michigan Rules of Professional Conduct 8.4(a)-(c). Costs were assessed in the amount of $401.07.

The Grievance Administrator filed a petition for review. In an order entered May 21, 1997, the Attorney Discipline Board affirmed the hearing panel's Order of Suspension.
