NOTICE OF SUSPENSION AND RESTITUTION WITH CONDITIONS Case No. 95-189-GA Robert Mann, P-17056, Detroit, Michigan, by Attorney Discipline Board Tri-County Hearing Panel #24.

1) Suspension - Thirty (30) Days; 2) Effective March 24, 1997. Respondent was retained to appeal a criminal conviction. The panel found, by a preponderance of the evidence, that respondent failed to seek post-conviction relief on the complainant's behalf and failed to keep the complainant reasonably informed concerning the status of the matter. Respondent's conduct was found to be in violation of MCR 9.104(1)-(4); and Michigan Rules of Professional Conduct 1.1(c); 1.3; 1.4; 3.2; and 8.4(a) and (c). Respondent also failed to appear at a disciplinary hearing. The panel originally ordered that respondent be suspended for ninety days and make restitution of $3,000. Respondent filed a petition for review, which resulted in the Attorney Discipline Board remanding the matter to the panel for further proceedings.

Following remand proceedings, the panel adopted its original findings regarding misconduct and ordered that respondent be suspended for thirty days, make restitution of $3,000, and refrain from accepting any further criminal appeals. Respondent filed a second petition for review, which he subsequently withdrew.

Costs were assessed in the total amount of $564.39.
