NOTICE OF SUSPENSION WITH CONDITIONS Case No. 95-146-GA James S. Childress, P-50204, Detroit, Michigan, by Attorney Discipline Board Tri-County Hearing Panel #12.

1) Suspension - 180 days; 2) Effective December 6, 1996. The first complainant consulted with respondent concerning the possible retention of his services in a divorce matter. The panel found, by a preponderance of the evidence, that respondent engaged in improper conduct in that he made an unwanted sexual advance upon the complainant.

The second complainant consulted with respondent concerning a divorce. The panel found, by a preponderance of the evidence, that respondent he engaged in improper conduct in that he acted in an extremely derogatory and disrespectful nature in dealing with the complainant and made remarks which were sexually obscene.

Respondent's conduct was found to be in violation of MCR 9.104(1)-(4) and Michigan Rules of Professional Conduct 6.5(a) and 8.4(a)and(c).

The panel ordered that respondent be suspended from the practice of law in Michigan for a period of 180 days, with conditions relevant to the established misconduct. Costs were assessed in the amount of $1,694.21.
