NOTICE OF REPRIMAND WITH CONDITIONS Case No. 96-77-GA James J. Viau, P-43335, Escanaba, Michigan, by the Attorney Discipline Board affirming Upper Peninsula Hearing Panel #3's Order of Reprimand With Conditions.

1) Reprimand; 2) Effective February 4, 1997. Respondent pled no contest to the allegations in the Formal Complaint that he struck a two-year-old child on November 29, 1994, causing her injuries. On October 30, 1995 respondent was convicted by no contest plea of Assault and Battery, a misdemeanor, in the 94th District Court. Respondent's conduct was found to be in violation of MCR 9.104(4) and (5); and Michigan Rules of Professional Conduct 8.4(a) and (b).

The panel ordered that respondent be reprimanded with conditions relevant to the established misconduct. Costs were assessed in the amount of $1,308.34.

The Grievance Administrator filed a petition for review seeking a 180-day suspension. On September 8, 1997, the Attorney Discipline Board issued an order affirming the reprimand and modifying the conditions.
