NOTICE OF SUSPENSION Case Nos. 96-260-GA; 97-1-FA James Stevenson Childress, P-50204, Detroit, Michigan, by Attorney Discipline Board Tri-County Hearing Panel #10.

1) Suspension - Eight (8) Months; 2) Effective December 6, 1996. Respondent was retained and paid $200 to represent the first complainant in regaining possession of a car which had been towed and impounded. The panel found, by default, that respondent neglected the matter and failed to answer the Request for Investigation.

Respondent was retained and paid $200 to represent the second complainant in a child custody matter. The panel found, by default, that respondent neglected the matter and failed to answer the Request for Investigation. Respondent also failed to answer the Formal Complaints.

Respondent's conduct was found to be in violation of MCR 9.103(C); MCR 9.104(1)-(4) and (7); MCR 9.113(A) and (B)(2); and Michigan Rules of Professional Conduct 1.1(c); 1.2(c); 1.3; 1.4(a); 2.1; 3.2; 3.4(c); 8.1(b); and 8.4(a) and (c).

The Panel ordered that respondent be suspended from the practice of law in Michigan for eight months, to run concurrently with the 180-day suspension imposed in Case No. 95-146-GA, which commenced on December 6, 1996. Costs were assessed in the amount of $511.96.
