NOTICE OF REVOCATION AND RESTITUTION Case Nos. 96-179-GA; 96-206-FA Michael B. Batchelor, P-38765, Detroit, Michigan, by Attorney Discipline Board Tri-County Hearing Panel #28.

1) Revocation; 2) Effective December 14, 1996. Respondent was retained to represent defendants in three separate criminal matters: one in 36th District Court; one in Recorder's Court; and one in 56-2 District Court. The panel found, by default, that respondent neglected the matters; failed to refund unearned fees totalling $6,500; knowingly made false statements to one client and his family; and failed to answer the Requests for Investigation. Respondent also failed to answer the Formal Complaints and failed to appear at the disciplinary hearing.

Respondent's conduct was found to be in violation of MCR 9.103(C); MCR 9.104(1)-(4)and(7); MCR 9.113(A)and(B)(2); and Michigan Rules of Professional Conduct 1.1(c); 1.2(a); 1.3; 1.4; 1.5(a); 1.15(b); 1.16(d); 3.2; 8.1(b); and 8.4(a)-(c).

The panel ordered that respondent's license to practice law in Michigan be revoked and that he make restitution to the complainants in the total amount of $6,500. Costs were assessed in the amount of $220.73.

NOTE: Respondent's license to practice law in Michigan was also revoked effective November 30, 1995.
