NOTICE OF REVOCATION AND RESTITUTION (By Consent)
Case Nos. 96-198-GA; 96-216-FA; 96-232-GA Barry W. Litvin, P-16736, Southfield, Michigan, by Attorney Discipline Board Tri-County Hearing Panel #81.
1) Revocation; 2) Effective November 28, 1996. Respondent was retained by six separate clients in a number of landlord/tenant and related matters. He pled nolo contendere to allegations that he neglected the matters; failed to refund unearned fees; knowingly made false statements to one client; failed to answer the Requests for Investigation; and failed to answer the Formal Complaint.
Respondent's conduct was alleged to be in violation of MCR 9.103(C); MCR 9.104(1)-(4)and(7); MCR 9.113(A)and(B)(2); and Michigan Rules of Professional Conduct 1.1(c); 1.3; 1.4(a)and(b); 1.5(a); 1.15(b); 1.16(d); 8.1(b); and 8.4(a)-(c).
The parties stipulated that respondent's license to practice law be revoked and that he make restitution in the total amount of $4,750. Costs were assessed in the amount of $244.06.
NOTE: Respondent was also suspended from the practice of law in Michigan for eighteen months effective June 27, 1996.
