NOTICE OF SUSPENSION AND RESTITUTION (By Consent)

Case No. 96-169-GA W. Frederick Moore, P-33341, Detroit, Michigan, by Attorney Discipline Board Tri-County Hearing Panel #27.

1) Suspension - thirty (30) days; 2) Effective November 26, 1996. Respondent was retained and paid $3,500 to represent the complainant on appeal of a criminal conviction. Respondent stipulated that he neglected the matter; failed to keep in reasonable communication with his client; abandoned the representation; and failed to refund the unearned fee or release the client file upon demand.

Respondent's conduct was found to be in violation of MCR 9.104(1)-(4); and Michigan Rules of Professional Conduct 1.1(a)- (c); 1.2(a); 1.3; 1.4; 1.5(a); 1.15(b); 1.16(d); 3.2; and 8.4(a)and(c).

At the disciplinary hearing held on October 25, 1996, the parties placed on the record a stipulation that respondent be suspended from the practice of law in Michigan for thirty days commencing November 26, 1996, and make restitution to the complainant in the amount of $3,500 on or before January 1, 1997. Costs were assessed in the amount of $103.68.
