NOTICE OF REPRIMAND WITH CONDITIONS Case No. 96-59-GA David H. Raaflaub, P-29975, Ann Arbor, Michigan, by Attorney Discipline Board Washtenaw County Hearing Panel #3.

1) Reprimand; 2) Effective November 13, 1996. Respondent was retained to institute litigation on behalf of the complainant against the Michigan Department of Corrections for violations of the Freedom of Information Act. He requested and received a $1,000 fee for the representation, and filed a lawsuit in Washtenaw County Circuit Court. The panel found that respondent neglected the matter, in violation of Michigan Rules of Professional Conduct 1.1(c); 1.3; and 1.4(a) and (b).

The panel ordered that respondent be reprimanded and complete a law office management course within one year. Costs were assessed in the amount of $749.73.

NOTE: Respondent filed a delayed petition for review. On January 28, 1997, the Attorney Discipline Board dismissed the petition for review for respondent's failure to file the required brief in support of petition for review. Respondent filed a motion for reconsideration, which was denied by the Board in an order entered April 1, 1997.
