NOTICE OF REVOCATION AND RESTITUTION Case Nos. 96-135-GA; 96-153-FA Andrew D. Morgan, P-46245, Grand Rapids, Michigan, by Attorney Discipline Board Kent County Hearing Panel #3.

1) Revocation; 2) Effective August 12, 1996. The panel found that the allegations of professional misconduct contained in the fifty-one count Formal Complaint were established by default. Those counts include repeated instances of client neglect and abandonment, failure to refund unearned fees, violation of an order of suspension of the U.S. Bankruptcy Court for the Western District of Michigan, and failure to answer Requests for Investigation. Respondent also failed to answer the Formal Complaints and failed to appear at the disciplinary hearing.

Respondent's conduct was found to be in violation of MCR 9.103(C); MCR 9.104(1)-(4)and(7); MCR 9.113(A)and(B)(2); MCR 9.119(D)and(E); MCL 600.916; MSA 27A.916; and Michigan Rules of Professional Conduct 1.1(c); 1.3; 1.4(a); 1.5(a); 1.15(b); 1.16(d); 3.2; 3.4(c); 5.5(a); 8.1(b) and 8.4(a)and(c).

The panel ordered that respondent's license to practice law be revoked effective August 12, 1996, the date of the disciplinary hearing, and that he make restitution to eight complainants in the total amount of $2,938.00. Costs were assessed in the amount of $278.76.

NOTE: This is the third revocation of respondent's license to practice law in Michigan. The two prior revocations were effective March 22, 1996 and July 30, 1996.
