1) Revocation; 2) Effective July 10, 1996. The panel found, by default, that respondent neglected a criminal appellate matter, including a conflict of interest, failure to keep his client informed and failure to respond to his client's inquiries; failed to answer three Requests for Investigation; and failed to answer the Formal Complaints. Respondent also failed to appear at the disciplinary hearing. Respondent's conduct was found to be in violation of MCR 9.103(C); MCR 9.104(1)-(4)and(7); MCR 9.113(A)and(B)(2); and the Michigan Rules of Professional Conduct, 1.1(c); 1.3; 1.4(a); 1.7(b); 1.15(b); 3.2; 8.1(b); and 8.4(a)and(c).
In ordering revocation, the panel specifically noted that respondent's prior disciplinary record--one reprimand and two one-year suspensions--reflected a pattern of misconduct and continuing indifference to his professional obligations. Costs were assessed in the amount of $207.58.
NOTE: Respondent has been continuously suspended from the practice of law in Michigan since October 13, 1995.
