NOTICE OF REPRIMAND (By Consent)

Case No. 95-243-GA John A. Mundell, Jr., P-18073, Detroit, Michigan, by Attorney Discipline Board Tri-County Hearing Panel #17.

1) Reprimand; 2) Effective July 9, 1996. Respondent prepared and filed an inventory on behalf of an estate. In that inventory, no reference was made as to the obligor under a certain $50,000 note. Respondent admitted that his failure to disclose that he was the obligor under that note exposed the legal professional to censure or reproach and was violative of MCR 9.104(2) and MRPC 8.4(a)and(c).

The Grievance Administrator and the respondent submitted a stipulation for consent order of discipline in accordance with MCR 9.115(F)(5). The stipulation was approved by the Attorney Grievance Commission and the hearing panel. The parties agreed that the respondent should be reprimanded and that he should execute a new note to be secured by a mortgage. Costs were assessed in the amount of $266.56.
