NOTICE OF SUSPENSION WITH CONDITIONS Case No. 95-63-GA Herbert H. Schebor, P-23988, Garden City, Michigan, by Attorney Discipline Board Tri-County Hearing Panel #15.

1) Suspension - sixty (60) days; 2) Commencing upon completion of and full compliance with Order of Suspension (By Consent) in Case No. 94-222-GA.

Respondent was retained to institute divorce proceedings. The panel found, by a preponderance of the evidence, that respondent failed to prosecute the divorce action; failed to respond to his client's inquiries or to keep her reasonably informed; knowingly made false representations to his client; and knowingly made a false statement in his answer to the Request for Investigation.

Respondent's conduct was found to be in violation of MCR 9.103(C); MCR 9.104(1)-(4),(6)and(7); MCR 9.113(A); and the Michigan Rules of Professional Conduct, 1.1(c); 1.3; 1.4; 3.2; 8.1(a)and(b); and 8.4(a)-(c).

The panel ordered that respondent be suspended from the practice of law for sixty days commencing upon completion of and full compliance with the Order of Suspension (By Consent) in Case No. 94-222-GA. [See Notice of Suspension (By Consent) dated July 31, 1995.] That order directed that respondent be suspended for thirty days commencing July 29, 1995, and until he files the accounting covering the period of his administration for the estate which was the subject matter of that Formal Complaint. The panel also ordered that prior to filing an affidavit of compliance with MCR 9.123(A), respondent shall attend and complete a Time Quest training seminar. Costs were assessed in the amount of $684.46.

NOTE: Respondent has been suspended from the practice of law in Michigan continuously since July 29, 1995.
