NOTICE OF SUSPENSION Case No. 94-98-GA Arnold D. Dunchock, P-13013, Corunna, Michigan, by the Attorney Discipline Board affirming Genesee County Hearing Panel #3's Order of Suspension.

1) Suspension - sixty (60) days; 2) Effective April 19, 1996. The panel found, by a preponderance of the evidence, that respondent failed to timely and/or properly respond to three Requests for Investigation; filed a false or misleading answer to one Request for Investigation; and failed to cooperate with successor counsel in a personal injury/wrongful death matter. Respondent's conduct was found to be in violation of MCR 9.103(C); MCR 9.104(1)-(4),(6)and(7); MCR 9.113(A)and(B)(2); and the Michigan Rules of Professional Conduct, 1.4; 1.15(b); 1.16(d); 8.1(a)and(b) and 8.4(a)-(c). On August 18, 1995, the panel entered an Order of Suspension for sixty days.

Respondent filed a petition for review. On December 1, 1995, the Attorney Discipline Board entered an Order Affirming Hearing Panel Order of Suspension. Respondent filed a motion for reconsideration and motion for stay. On January 5, 1996, the Board entered an Order Denying Reconsideration and Granting Motion for Stay.

Respondent filed an application for leave to appeal, which was denied by the Michigan Supreme Court in an order entered March 29, 1996. That order directed that the stay granted pursuant to MCR 9.122(C) remain in effect until 21 days after the order's entry. Respondent filed a motion for stay and a motion for reconsideration, which were denied by the Court in orders entered May 31, 1996.

Costs were assessed in the amount of $2013.64.
